Texas Civil Appeals Process

The Texas Court of Appeals handle both civil and criminal appeals. After review by the Texas Court of Appeals, however, the courts bifurcate. The Supreme Court of Texas reviews civil and juvenile cases, while the Texas Court of Criminal Appeals reviews criminal cases.

The Texas Supreme Court is comprised of nine Justices, and review by the Court is discretionary. The first two steps in the Texas appeals process are crucial:

  • Notice of Appeal - You must file a notice of appeal within the time allowed under the Court rules. It best to file a Notice of Appeal immediately at the close of a case.

  • Motion for a New Trial - A Motion for a New Trial extends the time you have to file a Notice of Appeal, and has the added benefit of allowing attorneys to argue facts not already in evidence. A common example of this is when an allegation of juror misconduct has occurred.
